What This Means (2024 FDD)
According to the 2024 Extreme Art Studio Franchise Disclosure Document, the Extreme Art Rider's effectiveness is tied to the Franchise Agreement. Specifically, if a franchisee operates multiple Extreme Art Studio Businesses, the Extreme Art Rider is required before opening the second and each subsequent studio. The document specifies that the obligations outlined in the Franchise Agreement apply individually to each Extreme Art Studio Business. This means that franchisees must adhere to the terms and conditions of the Franchise Agreement for each location they operate.
The FDD states that the Extreme Art Rider and the franchisee's right to operate the Rider Business will terminate upon the termination or expiration of the Franchise Agreement. This also applies if the Rider Business is transferred in compliance with the Franchise Agreement. The renewal provisions of Section 13 of the Franchise Agreement also govern the Rider. This clause underscores the dependency of the Rider on the overarching Franchise Agreement.
For a prospective franchisee, this means that the Extreme Art Rider is not a standalone agreement but an extension of the original Franchise Agreement. The rights and obligations under the Rider are contingent upon maintaining a valid and active Franchise Agreement. Any breach or termination of the Franchise Agreement would directly impact the franchisee's ability to operate additional Extreme Art Studio Businesses under the Rider. Therefore, understanding and complying with the terms of the Franchise Agreement is crucial for franchisees planning to expand their operations with multiple studios.
