What This Means (2024 FDD)

According to Extreme Art Studio's 2024 Franchise Disclosure Document, arbitration orders and awards can be enforced in specific locations. Extreme Art Studio and the franchisee can enforce arbitration orders and awards in the courts of the state(s) where the franchisee is domiciled or where their Extreme Art Studio Business is located. This is subject to applicable state law.

This means that while initial dispute resolution through mediation and arbitration takes place near Extreme Art Studio's principal place of business (Eden Prairie, Minnesota), the enforcement of any resulting orders or awards can occur in the franchisee's home state or the state where their studio operates. This provides a degree of convenience and legal recourse for the franchisee, as they do not necessarily have to travel to Minnesota to enforce an arbitration decision.

It is important to note the phrase "subject to applicable state law," which means that the specific procedures and requirements for enforcing arbitration awards may vary depending on the laws of the state in question. Franchisees should consult with legal counsel to understand the specific enforcement procedures in their state.
