Answer from 2024 FDD Document

If you satisfy all of the other conditions for a successor franchise, you and your owners agree to execute the form of franchise agreement and any ancillary agreements we then customarily use in granting franchises for Extreme Art Studio Businesses (modified as necessary to reflect the fact that it is for a successor franchise), which may contain provisions that differ materially from any and all of those contained in this Franchise Agreement, including without limitation the financial terms, the fees, and the territorial description.

What This Means (2024 FDD)

According to the 2024 Extreme Art Studio Franchise Disclosure Document, if a franchisee meets all other requirements for a successor franchise, both the franchisee and their owners must sign the franchise agreement form and any related agreements that Extreme Art Studio uses at the time for granting new franchises. These documents will be modified to reflect that they are for a successor franchise.

The FDD stipulates that the terms in these agreements may differ significantly from the original franchise agreement. This includes potential changes to financial terms, fees, and the description of the territory.

In addition to the franchise agreement, the franchisee may also need to execute a release in favor of Extreme Art Studio. This release is required as a condition of Extreme Art Studio's consent to enter into a successor franchise agreement. The release covers various considerations, including the consent by Extreme Art Studio and other valuable considerations, with the intention of being legally bound by the terms outlined in the release.
