Is upgrading an Eos Worldwide franchise tier optional?

We have established certain criteria for each of our tiers. Our criteria and the rights associated with each tier is described in Item 12 below and outlined in detail in our Operations Manual and may change from time to time at our discretion. If you meet the criteria outlined in the Operations Manual and elect to upgrade your tier, then you will pay the Membership Fee for that tier commencing the month your tier changes. Upgrading your tier is optional. If you fail to meet the criteria outlined in the Operations Manual resulting in us downgrading your tier, then you will pay the Monthly Membership Fee for that tier commencing the month you are downgraded. Implementers may also submit requests to downgrade their tier. We must approve any requests to downgrade your tier. After you upgrade your tier, we may place continuing ongoing qualifications, requirements or other necessary credentials you must satisfy to preserve your upgraded tier status.

What This Means (2025 FDD)
According to Eos Worldwide's 2025 Franchise Disclosure Document, upgrading your franchise tier is optional. The criteria for each tier and the associated rights are detailed in Item 12 of the FDD and the Operations Manual, which Eos Worldwide may change at its discretion.
If a franchisee meets the criteria outlined in the Operations Manual and chooses to upgrade their tier, they will be required to pay the Membership Fee for the new tier, starting from the month the tier changes. Conversely, if a franchisee fails to meet the criteria, Eos Worldwide may downgrade the tier, and the franchisee will then pay the Monthly Membership Fee for the downgraded tier, also commencing that month. Franchisees can also request a downgrade, but Eos Worldwide must approve such requests.
After upgrading, Eos Worldwide may impose ongoing qualifications, requirements, or credentials that the franchisee must maintain to preserve the upgraded tier status. This means that while upgrading is initially optional, maintaining the higher tier may require continuous effort and adherence to specific standards set by Eos Worldwide.
