Under what circumstances does Eos Worldwide reserve the right to vary standards for franchisees?

Eos_Worldwide Franchise · 2025 FDD

Answer from 2025 FDD Document

Because complete and detailed uniformity under many varying conditions may not be possible or practical, we specifically reserve the right and privilege, in our sole and unrestricted discretion and as we may deem to be in the best interests of all concerned in any specific instance, to vary standards for any franchisee or franchisees based on business potential, business practice or other factors we deem important to the successful operation of such franchise owner's business. We may grant to one (1) or more franchisees variations from standard specifications and practices as we determine in our sole and unrestricted discretion, and we shall have no obligation to grant you like or similar variations. You acknowledge that, over time, we have entered, and will continue to enter, into agreements with other franchisees that may contain provisions, conditions and obligations that differ from those contained in this Agreement. The existence of different forms of agreement does not in and of itself affect our or your duties to comply with the terms of this Agreement.

What This Means (2025 FDD)

According to the 2025 Eos Worldwide Franchise Disclosure Document, Eos Worldwide reserves the right to vary standards for franchisees under specific circumstances. Eos Worldwide retains the privilege to vary standards for any franchisee or franchisees based on business potential, business practice, or other factors they deem important to the successful operation of the franchisee's business. This decision is made at Eos Worldwide's sole and unrestricted discretion, as they deem to be in the best interests of all parties involved.

This means that Eos Worldwide has the flexibility to adjust the standard requirements and practices for individual franchisees based on factors that could influence their success. These factors can include the franchisee's business potential and their business practices.

Eos Worldwide may grant variations from standard specifications and practices to one or more franchisees without any obligation to grant similar variations to other franchisees. The FDD also states that Eos Worldwide has and will continue to enter into agreements with other franchisees that may contain different provisions, conditions, and obligations than those in the franchisee's agreement. However, the existence of different agreements does not affect the duty of either Eos Worldwide or the franchisee to comply with the terms of their specific agreement.
