What This Means (2025 FDD)
According to the 2025 Eos Worldwide Franchise Disclosure Document, the distinguishing trademarks of the EOS Franchise System include "EOS®", "Entrepreneurial Operating System®" and "EOS Implementer ®". The franchise agreement states that these marks, along with any other names and marks designated in writing by Eos Worldwide, are to be used in connection with the EOS Franchise System. These marks are part of the Intellectual Property licensed to franchisees.
As an Eos Worldwide franchisee, you are granted the right to use these trademarks as part of the franchise system, which also includes proprietary know-how, trade dress, operational procedures, and training programs. However, Eos Worldwide retains the right to modify or discontinue the use of these marks and other intellectual property, which could impact the branding and marketing strategies of your franchise.
Prospective franchisees should be aware that the right to use the EOS Franchise System's trademarks and intellectual property is derived solely from the franchise agreement and is limited to conducting the franchised business in compliance with the agreement. Franchisees must adhere strictly to the terms of the agreement and the policies outlined in the Operations Manual regarding the use of these trademarks. Additionally, franchisees cannot use Eos or EOS-related trademarked terms in their business entity's name without prior written permission from Eos Worldwide.
