What This Means (2025 FDD)
According to the 2025 Eos Worldwide Franchise Disclosure Document, Eos Worldwide has the right to restrict a franchisee's use of E-Commerce. Specifically, Eos Worldwide may limit a franchisee's and their clients' E-Commerce activities related to product and service purchases to a centralized website, portal, network, or other E-Commerce form designated and operated by Eos Worldwide or its designee.
This means that as an Eos Worldwide franchisee, your ability to independently engage in E-Commerce activities related to the franchise may be limited. Eos Worldwide can mandate that all online transactions and interactions related to the franchise's products and services occur through a specific platform or system that they control. This could impact a franchisee's flexibility in choosing their own E-Commerce solutions or customizing the online sales experience for their clients.
Furthermore, Eos Worldwide retains ownership of all data collected through E-Commerce related to the Eos Worldwide franchise system, intellectual property, and marks. This includes client data, click-stream data, cookies, user data, and hits. This data is considered confidential information belonging to Eos Worldwide. Franchisees must also adhere to all Eos Worldwide policies and procedures regarding E-Commerce use. This ensures that Eos Worldwide maintains control over the brand's online presence and customer data, which is a common practice in franchising to maintain consistency and protect brand integrity.
In practical terms, an Eos Worldwide franchisee needs to be prepared to operate within the E-Commerce framework established by Eos Worldwide. They should also be aware that Eos Worldwide has the right to modify this framework and that all E-Commerce data generated belongs to the franchisor. A prospective franchisee should discuss with Eos Worldwide what E-Commerce methods they designate, how they designate them, and what policies and procedures the franchisee will need to follow.
