Can Eos Worldwide require franchisees to participate in test marketing?
Eos_Worldwide Franchise · 2025 FDDAnswer from 2025 FDD Document
We formulate and modify our Franchise System Standards based upon the collective experience of our franchisees, affiliates, employees, and principals. We will disclose to you, in the Operations Manual or otherwise in writing, any specifications for the Services and the Products by designating approved brands, types, compositions, performance standards, qualities or suppliers. You must sell and offer for sale all Services required by us in the manner and method we require. You must not deviate from our Franchise System Standards without obtaining our prior written consent, and must discontinue selling and offering for sale any items and Services that we may disapprove in writing at any time. This creates a pure, consistent experience for all EOS Clients. We may periodically change our Franchise System Standards at our sole discretion and we reserve the unlimited right to formulate, modify and supplement our Franchise System Standards for operating the Franchised Business. We will try to provide you with as much written notice as possible of any changes as they occur, which may include through mail, e-mail, newsletters, posting on our Website, updates to the Operations Manual or by other means. You must implement all changes as soon as practical at your sole expense. You may incur increased costs to comply with our changes. We may also require you to occasionally participate in the test marketing of potential products and services.

What This Means (2025 FDD)
According to the 2025 Eos Worldwide Franchise Disclosure Document, Eos Worldwide may require franchisees to occasionally participate in the test marketing of potential products and services. This means that as a franchisee, you might be asked to implement and evaluate new offerings as part of a trial run before they are rolled out system-wide.
Participating in test marketing could involve additional time, effort, and potentially some costs, although the FDD does not specify if Eos Worldwide will cover these costs. Franchisees should be prepared to adapt to these requests and provide feedback on the new products or services being tested. This participation is part of maintaining and updating the Franchise System Standards, which Eos Worldwide formulates based on the collective experience of its franchisees, affiliates, employees, and principals.
While the FDD indicates that Eos Worldwide will try to provide written notice of any changes to the Franchise System Standards, including those related to test marketing, franchisees should be aware that these changes can occur at Eos Worldwide's sole discretion. Franchisees are responsible for implementing these changes as soon as practical and at their own expense, which may lead to increased operational costs. Therefore, prospective franchisees should inquire about the frequency and nature of test marketing activities to better understand the potential impact on their business operations and budget.
