What This Means (2025 FDD)

According to the 2025 Eos Worldwide Franchise Disclosure Document, a franchisee makes certain representations and warranties regarding the information provided to Eos Worldwide. Specifically, when submitting a franchise application, the franchisee represents and warrants that all information provided is true, complete, correct, and not misleading in any material respect. Eos Worldwide approves the application based on reliance upon these representations and warranties. This means that the franchisee is legally bound to ensure the accuracy and completeness of the information provided during the application process.

This representation is crucial because Eos Worldwide uses this information to evaluate the franchisee's suitability and financial capability. Any inaccuracies or omissions could potentially lead to a breach of the franchise agreement. Furthermore, Eos Worldwide has the right to share information about the franchisee's business, including historical performance data, with third parties such as other franchisees, prospective buyers, lenders, and prospective franchisees. This sharing of information is for legitimate business purposes, including benchmarking.

Additionally, the franchisee consents to the disclosure of Personal Information concerning them and the franchised business in Eos Worldwide's franchise disclosure document. This includes the franchisee's identity, business entity details (if applicable), address, email address, and telephone number. This consent allows Eos Worldwide to disclose this information whether or not such disclosure is required by law, and in other documents related to the sale of Eos Worldwide franchises. Therefore, franchisees should be aware that their personal and business contact information may be shared as part of the franchising process.

Eos Worldwide also provides email addresses for franchisees to use exclusively for business operations, including communication with Eos Worldwide, its affiliates, other franchisees, and clients. Franchisees must actively monitor these email accounts and not restrict Eos Worldwide's ability to communicate through them. Eos Worldwide retains the right to inspect and search these email accounts for legitimate business purposes, and franchisees should inform their personnel accordingly, ensuring these accounts are used only for franchised business operations.
