ITEM 13 TRADEMARKS
You receive the right to use the name "EOS®" which is the primary Mark used to identify our Franchise System. You may also use any other current or future Mark in connection with the operation of your Franchised Business that we designate in writing and in the manner we permit, including the logo on the front page of this Disclosure Document and the Marks listed below. By "Marks" we mean the trade names, trademarks, service marks and logos used to identify EOS and our Products and Services.
The Marks contain marks registered (the "Registered Marks") with the United States Patent & Trademark Office ("USPTO") and marks with current applications for registration pending (the "Pending Marks") with the USPTO. The following is a list of the principal Marks we may authorize you to use. EOS OpCo owns all of these Marks listed below. This list does not include all of the Marks the EOS OpCo owns, or that may be used in your Franchised Business, and we may add or subtract from this list from time to time.

What This Means (2025 FDD)
According to Eos Worldwide's 2025 Franchise Disclosure Document, EOS OpCo owns all of the Marks that Eos Worldwide franchisees are authorized to use. These marks include registered trademarks with the United States Patent & Trademark Office (USPTO) and marks with pending applications for registration with the USPTO. The primary mark is "EOS®," but franchisees may also use other current or future Marks designated by Eos Worldwide in writing.
Eos Worldwide has the right to use, license, and sublicense the Marks, copyrights, patents, know-how, and trade secrets owned and developed by EOS OpCo, under a license agreement between them. As of February 15, 2021, EOS OpCo licensed to Eos Worldwide a worldwide nonexclusive right to use and sublicense the Marks, Intellectual Property, and System for offering, selling, and operating Eos Worldwide businesses. This license agreement has a term of 99 years, but termination of the license agreement will not affect existing Franchise Agreements. Eos Worldwide will sublicense the right to use the Marks to franchisees to operate their Franchised Business, according to the terms of the Franchise Agreement.
This arrangement means that while Eos Worldwide franchisees use the trademarks to conduct business, the ultimate ownership resides with EOS OpCo. Franchisees must adhere to Eos Worldwide's guidelines for using the Marks and any goodwill associated with the Marks inures to the benefit of Eos Worldwide and its affiliates. Franchisees are also responsible for notifying Eos Worldwide of any potential infringements or challenges to the use of the Marks.
