Does Eos Worldwide have an obligation to grant a franchisee variations from standard specifications and practices similar to those granted to other franchisees?
Eos_Worldwide Franchise · 2025 FDDAnswer from 2025 FDD Document
Because complete and detailed uniformity under many varying conditions may not be possible or practical, we specifically reserve the right and privilege, in our sole and unrestricted discretion and as we may deem to be in the best interests of all concerned in any specific instance, to vary standards for any franchisee or franchisees based on business potential, business practice or other factors we deem important
to the successful operation of such franchise owner's business. We may grant to one (1) or more franchisees variations from standard specifications and practices as we determine in our sole and unrestricted discretion, and we shall have no obligation to grant you like or similar variations. You acknowledge that, over time, we have entered, and will continue to enter, into agreements with other franchisees that may contain provisions, conditions and obligations that differ from those contained in this Agreement. The existence of different forms of agreement does not in and of itself affect our or your duties to comply with the terms of this Agreement.

What This Means (2025 FDD)
According to Eos Worldwide's 2025 Franchise Disclosure Document, Eos Worldwide retains the right to vary standards for franchisees based on factors like business potential or practice. However, Eos Worldwide has no obligation to grant a franchisee the same variations given to other franchisees. This decision is at Eos Worldwide's "sole and unrestricted discretion."
This means that as a prospective franchisee, you cannot assume that any special arrangements or deviations from the standard franchise agreement offered to another franchisee will be extended to you. Eos Worldwide has the flexibility to tailor agreements and operational standards as they see fit, without necessarily providing similar terms to all franchisees.
This clause highlights the importance of carefully negotiating your own franchise agreement and understanding that the terms can vary significantly between franchisees. While uniformity is often a goal in franchising, Eos Worldwide explicitly reserves the right to make exceptions and adjustments on a case-by-case basis. Franchisees should not rely on the experiences or agreements of other franchisees when assessing their own rights and obligations.
It is also important to note that Eos Worldwide may enter into agreements with other franchisees that contain different provisions, conditions, and obligations. The existence of these different agreements does not affect either Eos Worldwide's or the franchisee's duty to comply with the terms of their specific agreement.
