What This Means (2025 FDD)
According to the 2025 Eos Worldwide Franchise Disclosure Document, the notice to renew the franchise term is generally irrevocable unless prohibited by applicable law. To renew the initial term for two additional terms of three years each, the franchisee must notify Eos Worldwide of their intention to renew in writing. This notice must be given at least 90 days, but no more than 360 days, before the expiration of the current term.
In addition to providing timely notice, the franchisee must meet several other conditions to qualify for renewal. These include completing any necessary refurbishment, modernization, maintenance, and upgrades to comply with Eos Worldwide's current franchise system standards. The franchisee must also not be in material breach of any agreements with Eos Worldwide or its suppliers, and must have satisfied all monetary obligations to them.
Furthermore, the franchisee will need to execute Eos Worldwide's then-current form of franchise agreement, which may have substantially different terms, including potentially increased fees and advertising obligations. The franchisee must also meet the qualifications and training requirements for renewing franchisees and sign a general release of claims in favor of Eos Worldwide. Finally, Eos Worldwide must still be offering and selling new franchises at the time of the renewal term.
