ITEM 13 TRADEMARKS
You receive the right to use the name "EOS®" which is the primary Mark used to identify our Franchise System. You may also use any other current or future Mark in connection with the operation of your Franchised Business that we designate in writing and in the manner we permit, including the logo on the front page of this Disclosure Document and the Marks listed below. By "Marks" we mean the trade names, trademarks, service marks and logos used to identify EOS and our Products and Services.
The Marks contain marks registered (the "Registered Marks") with the United States Patent & Trademark Office ("USPTO") and marks with current applications for registration pending (the "Pending Marks") with the USPTO. The following is a list of the principal Marks we may authorize you to use. EOS OpCo owns all of these Marks listed below. This list does not include all of the Marks the EOS OpCo owns, or that may be used in your Franchised Business, and we may add or subtract from this list from time to time.

Following registration of the Pending Marks, and at the appropriate times, we intend to renew the registrations and to file all appropriate affidavits.
We do not have a federal registration for some of our principal trademarks. Therefore, our trademark does not have many legal benefits and rights as a federally registered trademark. If our right to use the trademark is challenged, you may have to change to an alternative trademark, which may increase your expenses.
We have the right to the use, license and sublicense the Marks as well applicable copyrights, patents, know-how and trade secrets owned and developed by EOS OpCo (including any intellectual property developed by us, the "Intellectual Property"), under a license agreement between us and EOS OpCo (the "License Agreement").

What This Means (2025 FDD)
According to Eos Worldwide's 2025 Franchise Disclosure Document, not all of the marks that Eos Worldwide authorizes franchisees to use are registered with the United States Patent & Trademark Office (USPTO). Some marks are registered (the "Registered Marks"), while others have pending applications for registration (the "Pending Marks") with the USPTO. Eos Worldwide may also add additional trademarks for use with EOS Franchised Businesses which may not be federally registered.
The FDD includes a table listing several registered marks, along with their registration numbers and dates. These include marks such as "EOS," "ENTREPRENEURIAL OPERATING SYSTEM," "TRACTION," and others. However, Eos Worldwide states that the list provided is not exhaustive and may change over time.
The lack of federal registration for some trademarks carries potential risks for franchisees. Eos Worldwide acknowledges that unregistered trademarks do not have the same legal benefits and rights as registered ones. If the right to use an unregistered trademark is challenged, a franchisee may be required to switch to an alternative trademark, potentially increasing their expenses.
Prospective franchisees should carefully review the list of registered and pending marks in the FDD and inquire about the status of any unregistered marks they will be authorized to use. It would be prudent to discuss with Eos Worldwide the potential costs and risks associated with using unregistered trademarks and the process for transitioning to alternative marks if necessary.
