What This Means (2025 FDD)
According to the 2025 Eos Worldwide Franchise Disclosure Document, Item 11 and sections 4 and 11 of the Franchise Agreement outline the franchisee's advertising obligations. Item 11 discusses cooperative advertising programs, social media and internet advertising, the Brand Development Fund, marketing approval processes, and grand opening/start-up promotions.
Specifically, Eos Worldwide may establish cooperative advertising programs where franchisee contributions are determined based on factors they deem appropriate, potentially up to 1% of average gross session revenues annually. While franchisees may not have voting rights on these programs, Eos Worldwide states that their standard practice is to consult with community leaders and may form an advisory council.
The FDD also states that franchisees must adhere to brand guidelines when using social media for their franchised business. Franchisees need to ensure their online presence complies with Eos Worldwide's standards. All advertising and marketing efforts must be factual, ethical, and dignified, and franchisees must discontinue any advertising upon notice from Eos Worldwide.
Eos Worldwide does not currently have a Brand Development Fund but reserves the right to create one in the future. If established, the terms would align with marketing funds in other franchise systems. The fund aims to maximize public recognition of Eos Worldwide's brand, but there is no guarantee that expenditures will be proportionate to contributions from franchisees in any specific area.
