Who is considered the franchisee from a legal standpoint for Eos Worldwide?

Eos_Worldwide Franchise · 2025 FDD

Answer from 2025 FDD Document

The franchisor is EOS Worldwide Franchising, LLC, doing business as "EOS Worldwide," which will be referred to as "we", "us", or "EOSW" in this Disclosure Document. References to "you" or "your" means the individual person that acquires the franchise from us and will and operate the franchise as an EOS Implementer. EOS Implementers may operate the Franchised Business (as defined below) as a sole practitioner (sole proprietorship), or they may form a Business Entity (as defined below) to operate the Franchised Business. We use the terms "franchisee" and "Implementer" interchangeably to describe you, however, from a legal standpoint, the franchisee is the person or entity that signs the Franchise Agreement (as defined below).

What This Means (2025 FDD)

According to the 2025 Eos Worldwide Franchise Disclosure Document, the franchisee is legally defined as the individual or entity that formally signs the Franchise Agreement. Eos Worldwide uses the terms "franchisee" and "Implementer" interchangeably to describe the individual who acquires the franchise and operates it as an EOS Implementer.

For Eos Worldwide, franchisees can operate as a sole practitioner or through a Business Entity. If a franchisee chooses to operate through a Business Entity, that entity must sign the Franchise Agreement or a Joinder to Franchise Agreement, agreeing to abide by its terms.

This distinction is important because it clarifies who is legally bound by the terms of the franchise agreement. Whether it's the individual franchisee or their established business entity, the signing party is responsible for upholding the obligations outlined in the agreement with Eos Worldwide.
