What This Means (2025 FDD)
According to Eos Worldwide's 2025 Franchise Disclosure Document, breaching the Franchise Agreement can lead to termination. The FDD states that each obligation under the Franchise Agreement is considered material and essential, and failure to meet these obligations can result in the termination of the agreement.
The FDD outlines two categories of defaults: curable and non-curable. For curable defaults, Eos Worldwide provides a period to remedy the breach, typically 30 days from written notice. However, certain breaches, such as failing to remit monthly payments or unauthorized use of intellectual property, have shorter cure periods. Non-curable defaults, such as conviction of a crime, unauthorized transfer of the franchise, or repeated material defaults, can lead to immediate termination.
This means that as an Eos Worldwide franchisee, it is critical to understand and adhere to all requirements outlined in the Franchise Agreement. Failure to do so could jeopardize the franchise and result in its termination. Prospective franchisees should carefully review the termination clauses and ensure they can meet all obligations to avoid potential breaches and subsequent termination.
