- (a) The following terms shall have the following meanings:

According to Eos Worldwide's 2025 Franchise Disclosure Document, the Can-Spam Act of 2003 is a component of the brand's privacy compliance. Eos Worldwide requires franchisees to operate their franchised business in compliance with all Anti-Spam Laws. Franchisees must ensure that commercial messages are sent only to individuals who have consented to receive them, in accordance with Anti-Spam Law. The commercial messages must comply with all requirements prescribed by Anti-Spam Law. Franchisees must maintain evidence to prove their compliance with these provisions.
Furthermore, any request for consent to send commercial messages must constitute a valid request for express consent under Anti-Spam Law. Franchisees must maintain evidence of all consents given and clearly identify clients who have given, not given, or withdrawn their consent. Franchisees must also abide by all applicable international, national, federal, provincial, or municipal laws, codes, or regulations that regulate the processing of information, including laws regulating marketing communications and/or electronic communications, including applicable Anti-Spam Law.
