What This Means (2025 FDD)

According to the 2025 Eos Worldwide Franchise Disclosure Document, the franchisee is responsible for the costs associated with translating the Materials. The Materials include the Operations Manual and all components of the EOS System that are media subject to copyright or other intellectual property rights. The franchisee must first obtain written consent from Eos Worldwide before making any translations of the Materials. Eos Worldwide has the right to withhold consent at its sole discretion and may impose additional terms and conditions.

Before using any translations, the franchisee must provide Eos Worldwide with a copy and receive their prior written approval. The franchisee is also responsible for keeping all translations confidential, just like the original EOS materials. Eos Worldwide may also require the franchisee to use their Approved Suppliers for any translations.

Eos Worldwide retains ownership of the copyright and all other rights to any translations, modifications, or adaptations of the Materials, regardless of whether they were made in accordance with the agreement. The franchisee is required to assign all copyright and economic rights to Eos Worldwide and waive any moral rights related to the translated, modified, or adapted Materials. This assignment and waiver must also be secured from the franchisee's personnel and any third parties involved in the translation or modification process.

This means that if a franchisee wants to operate in a language other than English, they will incur the expense of translating all necessary materials, and Eos Worldwide will own the rights to those translations. The franchisee must also ensure that all copyright and proprietary notices are properly used in connection with any translated materials, adhering to Eos Worldwide's standards for protecting their rights.
