What This Means (2025 FDD)
According to the 2025 Eos Worldwide Franchise Disclosure Document, if a franchisee seeks to renew their franchise agreement, they must sign a general release in favor of Eos Worldwide and its affiliates. This requirement is conditional upon Eos Worldwide still offering and selling new franchises at the time of the Renewal Term.
Specifically, the franchisee must sign a general release in the form set forth on Exhibit A attached to the FDD, or any other form required or acceptable to Eos Worldwide. This release covers all claims arising out of or related to the Franchise Agreement or the franchise itself, up to the date of the release. The release extends to Eos Worldwide, its affiliates, and their respective members, owners, officers, directors, employees, consultants, advisors, agents, successors, and assigns, both in their corporate and individual capacities.
However, there is an exception: the general release does not cover claims and causes of action that cannot be released under applicable law. This condition ensures that franchisees do not waive any legal rights that are protected and non-waivable under the relevant jurisdiction's laws. If Eos Worldwide is no longer offering new franchises, this general release would not be required for renewal.
