Eos Worldwide retains significant control over the Brand Fund's operation. They determine how contributions are spent and can use any media they deem appropriate for advertising. This includes the discretion to use an in-house advertising department or outside agencies. A portion of the Brand Fund may also be allocated to creative concept production, website development, marketing surveys, and test marketing.

Eos Worldwide also directs all advertising activities, having sole discretion over creative concepts, materials, media, placement, and allocation. They determine the geographic and market areas for implementing advertising and promotional activities. The Brand Fund aims to maximize general public recognition of the Eos Worldwide brand; therefore, Eos Worldwide is not obligated to ensure that Brand Fund expenditures in any area are proportionate to the contributions from franchisees in that area or that any franchisee's business will directly benefit from the fund's use.
