Currently, there are no effective determinations of the USPTO, the United States Copyright Office, the Trademark Trial and Appeal Board, or the trademark administrator of any state or any court, nor any pending infringement, opposition or cancellation proceedings or material litigation, involving the copyrighted material. There are currently no effective agreements that significantly limit our right to use, license or sublicense the copyrighted material. Neither we nor our affiliates know of any infringing uses or superior prior rights that could materially affect your use of the copyrighted material.

What This Means (2025 FDD)

According to Dryject's 2025 Franchise Disclosure Document, there are currently no effective agreements that significantly limit Dryject's right to use, license, or sublicense the copyrighted material. This means that Dryject has full control over its copyrighted materials and can grant franchisees the right to use them without significant restrictions from outside parties. This is a positive aspect for potential franchisees, as it suggests that Dryject has secured its intellectual property rights and can confidently allow franchisees to utilize them.

Dryject also claims copyright in its written material, but franchisees are permitted to use the material as part of their franchised business. The information in the Manual is treated as confidential trade secrets. Franchisees must operate their franchised business strictly according to the Manual, as revised periodically, and must always treat the Manual and the information in it as confidential, according to the requirements of the Franchise Agreement.

This also means that franchisees must maintain all Confidential Information as confidential both during and after the term of the Franchise Agreement. "Confidential Information" includes all information, data, techniques and know-how designated or treated by Dryject as confidential and includes the Manual. Franchisees may not at any time disclose, copy or use any Confidential Information except as specifically authorized by Dryject. Under the Franchise Agreement, franchisees agree that all information, data, techniques and know-how developed or assembled by them or their employees or agents during the term of the Franchise Agreement and relating to the System will be deemed a part of the Confidential Information protected under the Franchise Agreement.
