Must all Dryject System Standards apply uniformly to all similarly situated franchisees?

Except as otherwise provided in this Agreement, System Standards may regulate any aspect of the operation and maintenance of DryJect franchised businesses, provided that all System Standards will apply uniformly to all similarly situated DryJect franchised businesses.
Because complete uniformity under varying conditions may be impossible or impractical, We reserve the right to vary the standards of eligibility, including financial terms and conditions, for any franchisee, including You, based upon the peculiarities of a particular territory, including density of population, business potential, population of trade area, existing business practices, or any other conditions which We determine to have, or potentially have, a significant effect on the successful operation of such franchisee's business. Variations from standard specifications and practices granted to other franchisees shall not under any circumstances be cause to require Us to grant to You a like or similar variation hereunder, either now or in the future.

What This Means (2025 FDD)
According to Dryject's 2025 Franchise Disclosure Document, the System Standards generally apply uniformly to all similarly situated Dryject franchisees. The FDD defines System Standards as the mandatory specifications, standards, operating procedures, and rules that Dryject periodically prescribes for the development and operation of DryJect franchised businesses. These standards may regulate any aspect of the operation and maintenance of DryJect franchised businesses.
However, Dryject retains the right to vary these standards based on the peculiarities of a particular territory. These peculiarities could include density of population, business potential, population of trade area, existing business practices, or any other conditions which Dryject determines to have a significant effect on the successful operation of a franchisee's business.
It is important to note that variations granted to other franchisees do not obligate Dryject to grant similar variations to another franchisee. This means that a Dryject franchisee cannot demand a variation simply because another franchisee received one. This clause provides Dryject with the flexibility to adapt its franchise system to different market conditions while maintaining overall control and consistency.
