and comply with the required System Standards. In other instances, no suitable alternative may exist. In order to protect Our interests in the System and Marks, We reserve the right to determine if You are meeting a required System Standard and whether an alternative is suitable to any recommendations or guidelines. The Operations Manual will remain confidential and the property of Us, constitutes a Trade Secret owned by Us, and may not be loaned to any person, or duplicated or copied in whole or in part in any manner, without Our prior written permission. We have the right to add to and otherwise modify the Operations Manual from time to time, as We deem

necessary, provided that no such addition or modification will alter Your fundamental status, rights and obligations under this Agreement.
