If Dryject finds more cost-efficient sources of non-proprietary supplies, are franchisees obligated to use them?

Although we are not required to perform these services under the Franchise Agreement, we may provide the following guidance and assistance on a continuing basis to enhance the growth and performance of the System:
- A. We may continue to search for more cost-efficient sources of non-proprietary supplies. With the strength of group purchasing, we may endeavor to purchase supplies and inventory at reduced prices.
- B. We will endeavor to maintain an inventory of promotional material and sales and service manuals, available at reasonable costs.
- C. We may perform periodic quality control visits to each Franchised Business. During these visits all operations may be inspected and recommendations made to correct deficiencies, improve techniques, and enhance the efficiency of each Franchise.

What This Means (2025 FDD)
According to Dryject's 2025 Franchise Disclosure Document, Dryject may search for more cost-efficient sources of non-proprietary supplies. The FDD states that Dryject may endeavor to purchase supplies and inventory at reduced prices by leveraging group purchasing power.
However, the FDD does not explicitly state that franchisees are obligated to use these more cost-efficient sources if Dryject finds them. Instead, Dryject will provide updated lists of approved items of equipment, fixtures, inventory, and supplies (by brand name and/or by standards and specifications) and updated lists of approved suppliers for those items.
This suggests that while Dryject aims to help franchisees reduce costs, the final decision on where to source non-proprietary supplies may still rest with the franchisee, as long as they adhere to Dryject's approved lists and standards. It would be prudent for a prospective franchisee to clarify with Dryject the extent to which they are required to adopt these cost-efficient sources if identified.
