What happens if Dryject does not approve or disapprove advertising materials within 30 days?

Dryject Franchise · 2025 FDD

Answer from 2025 FDD Document

You may develop advertising materials for your own use, at your own cost. You may not use any advertising materials unless we have approved them, 30 days in advance of use, in writing. Any plans or materials submitted by you to us that have not been approved or disapproved, in writing, within 30 days of receipt will be deemed approved. You must obtain our approval before you use any advertising and promotional materials, signs, forms and stationery unless we have previously approved them during the 12 months prior to their proposed use.

What This Means (2025 FDD)

According to Dryject's 2025 Franchise Disclosure Document, if a franchisee submits advertising materials to Dryject for approval, any materials not approved or disapproved in writing within 30 days of receipt will be considered approved. This means a Dryject franchisee can proceed with using those advertising materials.

This provision offers a degree of autonomy to the franchisee in their local advertising efforts. It prevents Dryject from indefinitely delaying or blocking advertising initiatives. However, it's crucial for franchisees to maintain records of their submissions to Dryject, including dates of submission, to demonstrate that the 30-day period has elapsed without a response, should any dispute arise.

It is important to note that this approval only applies to advertising materials not previously approved within the last 12 months. If Dryject has approved similar materials within the past year, the franchisee can continue using them without resubmission. This policy balances Dryject's need to maintain brand consistency with the franchisee's need for timely and flexible advertising options.
