According to the 2025 Dryject Franchise Disclosure Document, the franchisee is obligated to use their best efforts to ensure that the trainee complies with the terms outlined in the agreement. This obligation is in place to protect Dryject's trade secrets and system uniqueness.
The agreement specifies that the trainee must maintain the confidentiality of Dryject's trade secrets, use them only for the franchisee's business, and refrain from copying or disclosing these secrets without permission. The trainee also agrees not to engage in any actions that could harm the goodwill associated with the Dryject system. These stipulations are designed to prevent unfair competition and protect the franchisor's proprietary information.
If the trainee breaches the agreement, Dryject would be irreparably injured and without an adequate remedy at law. In such cases, Dryject is entitled to enforce the agreement against both the franchisee and the trainee. This enforcement may include seeking a temporary or permanent injunction and a decree for specific performance, without the need to furnish a bond or other security. The franchisor also retains the right to terminate the Franchise Agreement in the event of a breach.
