  • (f) You also agree that we may purchase, merge, acquire, be acquired by or affiliate with an existing competitive or non-competitive franchise or non-franchise network, chain or any other business regardless of the location of that other business' facilities, and that following such activity we may operate, franchise or license those other businesses and/or facilities under any names or marks other than (while this Agreement is in effect) the Marks, regardless of the location of these businesses and/or facilities, which may be within the Designated Territory or immediately proximate to the Designated Territory.

What This Means (2025 FDD)

According to the 2025 Dryject Franchise Disclosure Document, Dryject has the right to operate acquired businesses under names or marks other than the Dryject Marks. Specifically, Dryject can purchase, merge, acquire, be acquired by, or affiliate with an existing competitive or non-competitive franchise or non-franchise network, chain, or any other business, regardless of the location of that other business's facilities.

Following such an activity, Dryject may operate, franchise, or license those other businesses and/or facilities under any names or marks other than the Dryject Marks while the Franchise Agreement is in effect. This allowance applies regardless of the location of these businesses and/or facilities, even if they are within or immediately proximate to the franchisee's Designated Territory.

This clause provides Dryject with considerable flexibility in its growth strategy, allowing it to diversify its portfolio without being restricted to the Dryject brand. However, this could also mean that a Dryject franchisee might find themselves operating in the same territory as another business owned or franchised by Dryject, but operating under a different brand. This could potentially lead to market confusion or competition between brands under the same parent company.
