System Standards mean mandatory specifications, standards, operating procedures, and rules that We periodically prescribe for the development and operation of DryJect franchised businesses.
All references in this Agreement to System Standards will include any modifications, deletions and/or additions to the System Standards which are authorized by this Agreement or the Operations Manual.
The Operations Manual also will include guidelines or recommendations in addition to required System Standards.
In some instances, the required System Standards will include recommendations or guidelines to meet the required standards.
You may follow the recommendations or guidelines or some other suitable alternative, provided You meet and comply with the required System Standards.
In other instances, no suitable alternative may exist.
In order to protect Our interests in the System and Marks, We reserve the right to determine if You are meeting a required System Standard and whether an alternative is suitable to any recommendations or guidelines.
The Operations Manual will remain confidential and the property of Us, constitutes a Trade Secret owned by Us, and may not be loaned to any person, or duplicated or copied in whole or in part in any manner, without Our prior written permission.
We have the right to add to and otherwise modify the Operations Manual from time to time, as We deem
necessary, provided that no such addition or modification will alter Your fundamental status, rights and obligations under this Agreement. You shall always follow the directives of the Operations Manual, as it may be modified by Us from time to time. You acknowledge that such compliance by You is necessary to protect the integrity and reputation of Our System.

What This Means (2025 FDD)
According to the 2025 Dryject FDD, the Operations Manual outlines the prescribed methods, procedures, policies, standards, and specifications of the Dryject System. The FDD states that the franchisee must keep the Operations Manual confidential and that it constitutes a Trade Secret owned by Dryject. The franchisee must always follow the directives of the Operations Manual, as it may be modified by Dryject from time to time, to protect the integrity and reputation of the Dryject System.
The Operations Manual also includes guidelines and recommendations in addition to required System Standards. In some instances, the required System Standards will include recommendations or guidelines to meet the required standards. The franchisee may follow the recommendations or guidelines or some other suitable alternative, provided they meet and comply with the required System Standards. In other instances, no suitable alternative may exist.
Dryject retains the right to determine if a franchisee is meeting a required System Standard and whether an alternative is suitable to any recommendations or guidelines. Dryject also has the right to add to and otherwise modify the Operations Manual from time to time, as they deem necessary, provided that no such addition or modification will alter the franchisee's fundamental status, rights, and obligations under the Franchise Agreement.
