Can Dryject develop and franchise rights to trade names not specifically designated as Licensed Rights?

(c) Except as provided for in Section 4 of this Agreement above, the Franchised Business and Licensed Rights granted under this Agreement are non-exclusive, and We retain the right, in Our sole discretion:
(i) To continue to operate DryJect businesses and to use the Licensed Rights in any territory outside of Your Designated Territory, and to license others to do so; and,
(ii) To develop, use and franchise the rights to any trade names, trademarks, service marks, trade symbols, emblems, signs, slogans, insignias or copyrights not specifically designated by Us as Licensed Rights, for use with similar or different franchise systems in any territory, on such terms and conditions as We may deem advisable, and without granting You any rights.

What This Means (2025 FDD)
According to Dryject's 2025 Franchise Disclosure Document, Dryject retains specific rights regarding trade names, trademarks, and service marks. Dryject has the right to develop, use, and franchise rights to any trade names, trademarks, service marks, trade symbols, emblems, signs, slogans, insignias, or copyrights not specifically designated as Licensed Rights. This means Dryject can create new brands or systems and franchise them without granting existing franchisees any rights to them.
This clause gives Dryject considerable freedom to expand and diversify its franchise offerings. For a potential franchisee, this means that the rights granted are limited to those explicitly defined in the agreement. The franchisee should not expect to automatically benefit from any new brands or systems Dryject introduces.
Dryject also maintains control over the DryJect Internet Website and all associated digital content. Franchisees must adhere to Dryject's brand communication standards and obtain approval for any digital content they publish. Dryject also requires administrator privileges to all of the franchisee's software, email, social media, and e-commerce activities. This level of control ensures brand consistency and allows Dryject to manage the online presence of all franchises. Franchisees must also offer for sale all products and services that Dryject authorizes and cannot sell any other products or services without prior written approval.
