What This Means (2025 FDD)
According to the 2025 Dollar Rent A Car Franchise Disclosure Document, a franchisee's insurance policy must include a waiver of subrogation against Hertz, Thrifty, and/or Dollar, their affiliates, and their franchisees and subfranchisees. This requirement is part of the insurance obligations a franchisee must meet to protect Dollar Rent A Car and its related entities from potential claims and liabilities.
In practical terms, this means that if Dollar Rent A Car or its related entities (Hertz, Thrifty, their affiliates, franchisees, and subfranchisees) are responsible for damages or losses covered by the franchisee's insurance policy, the insurance company cannot seek to recover those payments from them. The waiver of subrogation ensures that Dollar Rent A Car and its related parties are shielded from any legal action by the franchisee's insurance carrier to recoup claim payments.
This requirement is intended to provide a layer of financial and legal protection for the Dollar Rent A Car system. By mandating this waiver, Dollar Rent A Car ensures that its brand, affiliates, and other franchisees are not exposed to additional financial risks due to incidents involving a franchisee's operations. Franchisees must ensure their insurance policies explicitly include this waiver to comply with the franchise agreement and maintain proper coverage.
It is important for prospective Dollar Rent A Car franchisees to carefully review their insurance policies with their insurance provider to confirm that the waiver of subrogation is correctly included. Failure to comply with this requirement could result in a breach of the franchise agreement and potential legal or financial repercussions.
