Under what condition is a Dickeys Barbecue Pit franchisee required to offer delivery services?
Dickeys_Barbecue_Pit Franchise · 2024 FDDAnswer from 2024 FDD Document
You must offer delivery services from your Restaurant if one of our designated third-party delivery providers offers delivery services in the Assigned Area. You must make accommodations for those delivery services in compliance with our standards, including limiting the delivery services to any delivery area we specify to you in writing. (See Item 8) Any delivery area we specify is not exclusive and we may engage, and/or allow other franchisees and third parties to engage, in any activities we desire within the delivery area without any restrictions (including allowing other Dickey's franchisees and delivery service providers to provide delivery services in the delivery area). Any delivery area we specify is nothing more than the geographic boundaries in which you may deliver those menu items approved for delivery from your Restaurant, and no other rights are granted to you.

What This Means (2024 FDD)
According to Dickeys Barbecue Pit's 2024 Franchise Disclosure Document, a franchisee is required to offer delivery services from their restaurant if one of Dickey's designated third-party delivery providers offers delivery services in the Assigned Area. The franchisee must also make accommodations for these delivery services in compliance with Dickey's standards. These accommodations may include limiting the delivery services to any delivery area Dickey's specifies in writing.
It is important to note that any delivery area specified by Dickey's is not exclusive. Dickey's may engage, and/or allow other franchisees and third parties to engage, in any activities they desire within the delivery area without any restrictions. This includes allowing other Dickey's franchisees and delivery service providers to provide delivery services in the delivery area. The delivery area specified is simply the geographic boundaries in which the franchisee may deliver approved menu items from their restaurant.
This requirement to offer delivery services if a third-party provider is present in the Assigned Area could impact a franchisee's operational costs and logistics. Franchisees should confirm which third-party delivery services Dickey's designates and understand the associated costs and standards for compliance. Additionally, franchisees should be aware that Dickey's retains the right to modify delivery areas and engage other parties in delivery services within those areas, which could affect a franchisee's delivery business.
