Can Dickeys Barbecue Pit specify a delivery area for my restaurant?

Dickeys_Barbecue_Pit Franchise · 2024 FDD

Answer from 2024 FDD Document

You must offer delivery services from your Restaurant if one of our designated third-party delivery providers offers delivery services in the Assigned Area. You must make accommodations for those delivery services in compliance with our standards, including limiting the delivery services to any delivery area we specify to you in writing. (See Item 8) Any delivery area we specify is not exclusive and we may engage, and/or allow other franchisees and third parties to engage, in any activities we desire within the delivery area without any restrictions (including allowing other Dickey's franchisees and delivery service providers to provide delivery services in the delivery area). Any delivery area we specify is nothing more than the geographic boundaries in which you may deliver those menu items approved for delivery from your Restaurant, and no other rights are granted to you.

What This Means (2024 FDD)

According to Dickeys Barbecue Pit's 2024 Franchise Disclosure Document, franchisees must offer delivery services if a designated third-party delivery provider offers such services in their assigned area. Dickeys Barbecue Pit retains the right to specify a delivery area for the franchisee in writing. However, this delivery area is not exclusive, and Dickeys Barbecue Pit can engage other franchisees or third parties to operate within the same delivery area without restrictions.

This means that while Dickeys Barbecue Pit can define the geographic boundaries where a franchisee may deliver approved menu items, it does not grant any exclusive rights within that area. Other Dickeys Barbecue Pit franchisees or third-party delivery services can also operate in the same zone. This non-exclusive arrangement allows Dickeys Barbecue Pit flexibility in managing delivery services across its franchise network.

For a prospective franchisee, this implies that they should not expect a protected delivery territory. Competition from other franchisees or third-party services within the specified delivery area is possible. Therefore, franchisees need to focus on efficient operations and customer service to compete effectively. Understanding the dynamics of delivery services and potential competition is crucial for financial planning and business strategy.

It is important to note that Dickeys Barbecue Pit may engage in any activities it desires within the delivery area without any restrictions, including allowing other Dickey's franchisees and delivery service providers to provide delivery services in the delivery area.
