What This Means (2024 FDD)
According to the 2024 Deka Lash Franchise Disclosure Document, Deka Lash is prohibited from restricting a franchisee in Washington from soliciting or hiring any employee of a Deka Lash franchisee. This means that any provisions within the franchise agreement that attempt to prevent a franchisee from hiring employees of other Deka Lash locations are void and unenforceable in Washington state.
This protection is due to RCW 49.62.060, a Washington state law that specifically addresses this issue. The law aims to promote fair competition and employee mobility within franchise systems. It prevents franchisors from imposing restrictions that could limit the employment opportunities of individuals working within the Deka Lash franchise network in Washington.
For a prospective Deka Lash franchisee in Washington, this is a significant benefit. It allows them the freedom to recruit experienced employees from other Deka Lash locations, potentially gaining skilled staff who are already familiar with the Deka Lash system. However, franchisees should be aware that this also means their own employees could be recruited by other franchisees within the system. Franchisees should focus on employee retention strategies to keep their valued staff.
It's important for potential franchisees to understand that while Deka Lash cannot enforce restrictions on hiring from other franchises in Washington, other employment laws and regulations still apply. Franchisees must still comply with all applicable labor laws, including those related to non-discrimination, wage and hour requirements, and employee contracts.
