What This Means (2024 FDD)
According to the 2024 Deka Lash Franchise Disclosure Document, before a franchisee signs a lease, sublets a space, purchases a space, or makes any binding commitment to do so, they must obtain written approval of the proposed location from Deka Lash.
Furthermore, the franchisee must provide Deka Lash with a true copy of the lease, including any additions or amendments, promptly after execution. Deka Lash also requires that any lease or sublease of the franchise premises includes the Franchisor Addendum and Conditional Assignment of Lease as outlined in Exhibit F-1 or an assignment of the lease in a form approved by Deka Lash.
This requirement ensures that Deka Lash maintains control over the location of its franchises, which is a common practice in franchising. By requiring approval, Deka Lash can ensure that the location meets its standards and is likely to be successful. The inclusion of specific addenda or assignment clauses in the lease protects Deka Lash's interests in the event of a transfer or termination of the franchise agreement.
