What This Means (2024 FDD)
According to Deka Lash's 2024 Franchise Disclosure Document, the Minnesota Addendum to the Franchise Agreement specifies certain franchisee rights that cannot be diminished by anything within the Franchise Disclosure Document or the agreements themselves. These rights include any rights provided to the franchisee as outlined in Minnesota Statutes, Chapter 80C, and the franchisee's rights to any procedure, forum, or remedies as provided by Minnesota law. This protection ensures that Minnesota franchisees retain all rights and legal recourse afforded to them under state law, regardless of what the franchise agreement might otherwise state.
This provision is particularly important for prospective Deka Lash franchisees in Minnesota as it reinforces the legal protections available to them under state franchise laws. It prevents Deka Lash from using the franchise agreement to override or reduce these statutory rights. This can be a significant benefit, as it ensures that franchisees have access to fair legal processes and remedies in case of disputes with the franchisor.
For example, if a standard clause in the Deka Lash franchise agreement conflicted with a right guaranteed to franchisees under Minnesota Statutes, Chapter 80C, the state law would prevail. This addendum aims to create a more balanced relationship between the franchisor and franchisee by preserving the franchisee's legal rights within the state of Minnesota.
