Advertising and Marketing. You must use advertising material provided by us, a vendor that we designate, or we must approve the advertising in writing, prior to its use.
We reserve the right to form, change, dissolve or merge any Local Advertising Cooperative. (Franchise Agreement, Section 7.5).
You agree to advertise, at your expense, in such online directories, advertising agencies, advertising fees and/or other promotional efforts as specified by us from time to time in our manuals. We have the right to place such listings, advertising, fees or promotions, on your behalf and collect the cost from you.
What This Means (2024 FDD)
According to the 2024 Deka Lash Franchise Disclosure Document, franchisees face specific restrictions on their advertising and marketing activities. Deka Lash requires franchisees to use advertising material provided by them or a vendor they designate. If franchisees choose to create their own advertising, Deka Lash must provide written approval before it is used. This ensures that all advertising aligns with the brand's standards and messaging.
Item 11 states that Deka Lash reserves the right to form, change, dissolve, or merge any Local Advertising Cooperative. Franchisees are required to contribute a monthly Brand Development Fee, which is the greater of 3% of gross studio sales or, after one year of being open, $500 per month. These fees are used for various marketing and promotional activities, including advertising, promotional events, graphic design, and public relations. Deka Lash has the right to develop all media and marketing programs and has the final decision on all promotions, creative concepts, and media.
These restrictions and cooperative advertising programs mean that Deka Lash franchisees have limited autonomy over their advertising efforts. While they contribute to the Brand Development Fund, Deka Lash controls how those funds are spent and the creative direction of advertising campaigns. Franchisees must adhere to Deka Lash's guidelines and obtain approval for any advertising they wish to undertake independently. This structure ensures brand consistency but may limit a franchisee's ability to tailor advertising to their specific local market without franchisor approval.
Furthermore, Deka Lash may require franchisees to advertise in online directories, advertising agencies, and other promotional efforts as specified in their manuals. Deka Lash has the right to place these listings and promotions on the franchisee's behalf and collect the costs from them. This further centralizes advertising control with Deka Lash, ensuring a unified brand image but potentially reducing the franchisee's direct influence over their local marketing strategies.
