You are responsible for finding the location of the Franchise Premises. We recommend that you contact a knowledgeable commercial real estate agent or other knowledgeable advisor to help you determine potential locations for your Franchise Premises. We provide to you criteria to help you select a site. We will typically approve or disapprove a proposed site within 14 days of your submission to us of the information required by us on the proposed site. We will not be liable for any consequences of your choice of any site for your Franchise. Any site recommendation or approval we make is not a representation that any particular site is available or legally appropriate for use as a site for your Franchise. It is your responsibility to investigate all applicable zoning, licensing, leasing and other requirements for any proposed site. You must ensure that the site you select complies with these requirements. You are responsible for all expenses related to site selection and lease or purchase agreement negotiation. In the unlikely event that you and we cannot agree on a site within the opening timeframe allowed, you can extend the timeline by getting approved and paying the opening deadline extension fee, we can allow you more time to search for a site that we can agree upon or we can terminate the franchise agreement.

According to Deka Lash's 2024 Franchise Disclosure Document, the franchisee is exclusively responsible for investigating zoning, licensing, and leasing requirements for any proposed site. Deka Lash recommends that franchisees contact a knowledgeable commercial real estate agent or other knowledgeable advisor to help determine potential locations for the Franchise Premises. Deka Lash provides criteria to help franchisees select a site and will typically approve or disapprove a proposed site within 14 days of the franchisee's submission of the required information.
It is the franchisee's responsibility to ensure the site complies with all applicable zoning, licensing, leasing, and other requirements. The franchisee is also responsible for all expenses related to site selection and lease or purchase agreement negotiation. Deka Lash will not be liable for any consequences of the franchisee's choice of any site for the franchise. Franchisees are also responsible for conforming the premises to federal, state, or local ordinances, building codes, and licensing requirements, including those required for a studio that offers Deka Lash services, and for obtaining any required permits. Franchisees are required to have the site laid out by Deka Lash's approved furniture supplier and must submit the layout for approval. Once approved by Deka Lash, the franchisee is responsible for remodeling the premises and installing the furniture, fixtures, and equipment accordingly.
In the event that the franchisee and Deka Lash cannot agree on a site within the opening timeframe allowed, the franchisee can extend the timeline by getting approval and paying the opening deadline extension fee. Alternatively, Deka Lash can allow the franchisee more time to search for a site that they can agree upon, or they can terminate the franchise agreement.
