What This Means (2024 FDD)
According to Deka Lash's 2024 Franchise Disclosure Document, the franchisee is solely responsible for all aspects of employee management, including compensation. Specifically, the franchisee is responsible for hiring, firing, compensating, paying applicable payroll taxes, and the day-to-day supervision and control of their employees. This means that Deka Lash franchisees have complete control over their staff but also bear the full responsibility for all employment-related costs and legal compliance.
This allocation of responsibility is typical in franchising, where franchisees operate as independent business owners. Deka Lash will not be liable for any wages, commissions, or other compensation due to the franchisee's employees. The franchisee must also maintain employee records that clearly demonstrate that the employees are employed by the franchisee and not by Deka Lash.
Furthermore, the Deka Lash franchisee is required to comply with all state and federal laws pertaining to their employees, including wage and hour laws. The franchisee acknowledges having the opportunity to consult with independent legal counsel regarding these laws before signing the Franchise Agreement. The franchisee must also indemnify and hold Deka Lash harmless from any violations of these laws. This underscores the importance of understanding and adhering to employment laws to avoid potential legal issues and liabilities.
In summary, as a Deka Lash franchisee, you have the autonomy to manage your employees but must also handle all associated financial and legal responsibilities. This includes ensuring proper training, certifications, and adherence to all applicable employment laws, as well as covering all wages, compensation, and payroll taxes.
