What This Means (2024 FDD)
According to Deka Lash's 2024 Franchise Disclosure Document, Deka Lash can modify the provisions of the manual without the franchisee's consent. However, any modifications to the actual franchise agreement must be in writing and signed by both the franchisee and an authorized officer of Deka Lash to be effective. This ensures that while Deka Lash retains the flexibility to update operational guidelines, the core contractual terms remain stable unless both parties agree to changes in writing.
This ability to unilaterally modify the manual is a fairly standard practice in franchising, allowing franchisors to adapt to changing market conditions, improve operational efficiency, and maintain brand standards across all locations. The operations manual typically covers day-to-day procedures, marketing strategies, and other guidelines that are subject to change as the business evolves. Franchisees are expected to adhere to these changes as part of their agreement.
For a prospective Deka Lash franchisee, this means it is crucial to stay informed of any updates to the manual and to understand that these changes are a condition of maintaining the franchise. While Deka Lash needs the flexibility to update the manual, franchisees should seek clarification on how frequently the manual is updated, the process for communicating changes, and whether there is a mechanism for franchisees to provide feedback on proposed modifications. Understanding these aspects can help a franchisee better prepare for and adapt to changes in operational procedures and standards.
