What This Means (2024 FDD)
According to the 2024 Deka Lash Franchise Disclosure Document, a franchisee selling or transferring their Deka Lash franchise must comply with the post-termination provisions outlined in the Franchise Agreement. This requirement is one of several conditions that Deka Lash may impose to approve the transfer.
Other conditions for approval include ensuring that the franchisee is current on all monetary obligations to Deka Lash, its affiliates, and designated suppliers, and that the franchisee is in full compliance with the Franchise Agreement. The franchisee must also execute any transfer, amendment, or release forms required by Deka Lash and provide copies of proposed transfer documents.
Additionally, the transferee must meet Deka Lash's standards for education, managerial and business acumen, moral character, business reputation, and credit rating. The transferee must also demonstrate the aptitude and financial resources necessary to meet the obligations under the Franchise Agreement, execute the then-current Franchise Agreement, and complete the initial training program at their own expense. The transferee must also obtain all necessary permits and licenses and ensure that lessors or other relevant parties consent to the transfer, in accordance with applicable laws.
