What is the Deka Lash franchisee responsible for regarding site selection expenses?

According to Deka Lash's 2024 Franchise Disclosure Document, the franchisee is responsible for all expenses related to site selection and lease or purchase agreement negotiation. Deka Lash recommends that franchisees contact a knowledgeable commercial real estate agent or other knowledgeable advisor to help determine potential locations for their Franchise Premises.

While Deka Lash provides criteria to help select a site and will typically approve or disapprove a proposed site within 14 days of submission of the required information, the franchisee bears the ultimate responsibility for finding the location. Deka Lash will not be liable for any consequences of the franchisee's site choice. Any site recommendation or approval made by Deka Lash does not guarantee the site's availability or legal appropriateness for use as a franchise location.

It is the franchisee's duty to investigate all applicable zoning, licensing, leasing, and other requirements for any proposed site and ensure that the selected site complies with these requirements. If the franchisee and Deka Lash cannot agree on a site within the opening timeframe, the franchisee can extend the timeline by getting approved and paying the opening deadline extension fee, or Deka Lash can allow more time to search for a site that they can agree upon, or Deka Lash can terminate the franchise agreement.
