According to Deka Lash's 2024 Franchise Disclosure Document, if a franchisee fails to meet their Area Development obligations but is current on their financial obligations, in compliance with their agreements, and showing a good faith effort to open their next scheduled studio, they may be charged a Delayed Opening Fee. This fee is $500 for each territory when that territory is due.
The Development Schedule Extension Fee must be paid to Deka Lash through their then-current royalty collections process. For each month the fee is paid, the development schedule for each of those unit rights will be extended by one month. Deka Lash allows franchisees to pay this Delayed Opening Fee for up to 12 months.
It's important to note that if a Deka Lash franchisee does not pay the delayed opening fee, stops or refutes the ability to ACH the transaction, notifies Deka Lash in writing that they no longer want to be charged the delayed opening fees, or after a period of 12 months of paying the delayed opening fee, they will immediately lose their protected territory rights and all accompanying transferability rights. Additionally, Deka Lash retains all rights to approve the studio location(s).
