What This Means (2024 FDD)

According to Deka Lash's 2024 Franchise Disclosure Document, franchisees are responsible for finding a location for their Deka Lash studio, and Deka Lash recommends consulting a commercial real estate agent or advisor. Deka Lash provides franchisees with site selection criteria to aid in this process. Franchisees must obtain written approval from Deka Lash for their proposed site and can only operate the Franchised Business at the accepted location. Deka Lash will typically approve or disapprove a proposed site within 14 days of receiving the required information. However, Deka Lash is not liable for any consequences resulting from the franchisee's site choice.

It is the franchisee's responsibility to ensure the selected site complies with all applicable zoning, licensing, leasing, and other requirements. The franchisee is also responsible for all expenses related to site selection and lease or purchase agreement negotiation.

If a franchisee and Deka Lash cannot agree on a site within the allowed timeframe, the franchisee can request an extension by paying an opening deadline extension fee. Alternatively, Deka Lash may allow more time to search for a mutually agreeable site, or the franchise agreement may be terminated. This highlights the importance of thorough due diligence and communication during the site selection process to avoid potential delays or termination of the agreement.

Once a site is selected, the franchisee is responsible for conforming the premises to all applicable ordinances, building codes, and licensing requirements. The franchisee must also have the site laid out by Deka Lash's approved furniture supplier and submit the layout for approval, which Deka Lash will typically approve or disapprove within 14 days. After layout approval, the franchisee is responsible for remodeling the premises and installing furniture, fixtures, and equipment accordingly.
