Answer from 2025 FDD Document

A release or waiver of rights executed by a franchisee may not include rights under the Washington Franchise Investment Protection Act or any rule or order thereunder except when executed pursuant to a negotiated settlement after the agreement is in effect and where the parties are represented by independent counsel. Provisions such as those which unreasonably restrict or limit the statute of limitations period for claims under the Act, or rights or remedies under the Act such as a right to a jury trial, may not be enforceable.

What This Means (2025 FDD)

According to Deer Solution's 2025 Franchise Disclosure Document, provisions that unreasonably restrict or limit the statute of limitations period for claims under the Washington Franchise Investment Protection Act may not be enforceable. This means that any clause in the franchise agreement that unduly shortens the time a franchisee has to bring a claim under the Act could be deemed invalid.

This protection ensures that Deer Solution franchisees in Washington have a fair opportunity to pursue legal claims related to violations of the Washington Franchise Investment Protection Act. It prevents Deer Solution from enforcing contract terms that would unfairly limit a franchisee's ability to seek legal recourse within a reasonable timeframe.

It is important for prospective Deer Solution franchisees in Washington to understand that while the franchise agreement may contain certain limitations, these limitations are subject to the protections afforded by Washington law. Franchisees should consult with an attorney to fully understand their rights and the applicable statute of limitations for any potential claims under the Washington Franchise Investment Protection Act.
