- Local Marketing You are not authorized to engage in any marketing unless it is pre-approved by us (Franchise Agreement, Article 9.B.), in our discretion. On an on-going annual basis, you must spend not less than $10,000 per Territory per year on the local marketing of your Deer Solution Business to customers located within your Operating Territory and in accordance with our standards and specifications. We, at our option, may require you to pay this amount to us or our affiliate to conduct the local marketing for your Franchised Business. We will review your local marketing programs and notify you if we approve same. We will make available to you and provide you with access, in the form of a source document, to our approved marketing campaigns, media, and messaging that may be used by you. In those instances where we provide you with access to our marketing campaigns, we provide you with the source designs, copy, and design specifications. and using such marketing campaigns and in having them printed, distributed and/or placed

What This Means (2025 FDD)
According to Deer Solution's 2025 Franchise Disclosure Document, Deer Solution is not required to spend any money on advertising in a franchisee's operating territory. However, franchisees are required to spend a minimum of $10,000 per territory annually on local marketing. Deer Solution retains the option to collect this amount from the franchisee and manage the local marketing efforts themselves. All marketing materials used by the franchisee must receive prior written approval from Deer Solution to ensure they meet the franchisor's standards.
Deer Solution may establish a local or regional advertising cooperative, requiring franchisees within the designated market to contribute. While no cooperatives currently exist, if one is established in a franchisee's area, participation is mandatory. The cooperative determines contribution amounts and marketing expenditures, but Deer Solution can mandate that decisions require approval from a majority of franchisee members. The maximum contribution required for a cooperative is $10,000 per territory per year.
Deer Solution also has the option to create a Brand Development Fund, to which franchisees must contribute up to 3% of their weekly gross sales. These funds can be used for various marketing and development activities, including market research, service and product development, and advertising. However, the Brand Development Fund will not be used to directly promote an individual Deer Solution Business or its specific marketing area. Franchisees are responsible for the costs of customizing, duplicating, and using Deer Solution's approved marketing campaigns.
