- Local Marketing You are not authorized to engage in any marketing unless it is pre-approved by us (Franchise Agreement, Article 9.B.), in our discretion. On an on-going annual basis, you must spend not less than $10,000 per Territory per year on the local marketing of your Deer Solution Business to customers located within your Operating Territory and in accordance with our standards and specifications. We, at our option, may require you to pay this amount to us or our affiliate to conduct the local marketing for your Franchised Business. We will review your local marketing programs and notify you if we approve same. We will make available to you and provide you with access, in the form of a source document, to our approved marketing campaigns, media, and messaging that may be used by you. In those instances where we provide you with access to our marketing campaigns, we provide you with the source designs, copy, and design specifications. However, you will incur the direct costs associated with customizing, duplicating,
and using such marketing campaigns and in having them printed, distributed and/or placed

What This Means (2025 FDD)
According to Deer Solution's 2025 Franchise Disclosure Document, Deer Solution is not required to spend any amount on advertising in a franchisee's operating territory. However, franchisees are required to spend a minimum of $10,000 per territory annually on local marketing for their Deer Solution business. This marketing must adhere to Deer Solution's standards and specifications and requires pre-approval. Deer Solution has the option to collect this $10,000 and manage the local marketing efforts themselves or through an affiliate.
While Deer Solution isn't obligated to spend on advertising in a franchisee's territory, franchisees must contribute to a Brand Development Fund, capped at 3% of weekly gross sales. These funds can be used for various marketing and advertising initiatives at the discretion of Deer Solution. However, these Brand Development Funds will not be used to directly promote an individual Deer Solution Business or its specific marketing area.
Deer Solution may also establish local or regional advertising cooperatives, requiring franchisees within those designated markets to contribute. The contribution amount and frequency are determined by the cooperative members. Franchisees will not be required to contribute more than $10,000 per Territory per year to such a cooperative. Deer Solution retains the right to form, change, dissolve, or merge any advertising cooperative.
