What This Means (2025 FDD)
According to the 2025 Deer Solution Franchise Disclosure Document, the purpose of modifying the Administrative Office after the termination of a franchise is to prevent confusion among the public regarding the continued operation of a Deer Solution business at that location. The franchisee is responsible for these modifications, which include de-identifying the office to differentiate it from its former appearance as a Deer Solution business.
Specifically, the franchisee must remove all distinctive physical and structural features, signs, trade dress, and emblems associated with the Deer Solution system, including those bearing the licensed marks. Additionally, the franchisee must make any other changes reasonably requested by Deer Solution to completely de-identify the former business. This ensures that the public does not mistakenly believe that a Deer Solution business is still operating at the location.
The franchisee is required to begin these actions immediately and complete them within the timeframe specified by Deer Solution. If the franchisee fails to do so, Deer Solution has the right to enter the premises and make the alterations themselves, at the franchisee's expense. Furthermore, the FDD states that failure to comply with these modification requirements will cause irreparable injury to Deer Solution, and the franchisor can seek a court order to enforce these changes at the franchisee's expense.
This requirement is typical in franchising to protect the brand's integrity and prevent customer confusion after a franchise agreement ends. By ensuring that a former location is clearly no longer associated with the Deer Solution brand, the franchisor can maintain consistent brand representation and avoid potential damage to its reputation.
