What This Means (2025 FDD)
According to the 2025 Deer Solution Franchise Disclosure Document, after termination, a franchisee must remove all features that identify the business as a Deer Solution franchise from their administrative office. This includes physical and structural elements, as well as signs, trade dress, and emblems associated with the Deer Solution system, especially those bearing the licensed marks. The goal is to completely differentiate the office from its former appearance to avoid public confusion.
Deer Solution has the authority to specify additional changes needed to de-identify the former franchise location. The franchisee is responsible for the costs associated with these alterations and must complete them within the timeframe specified by Deer Solution. If the franchisee fails to make these changes promptly, Deer Solution or its agents may enter the premises to make the alterations themselves, with all expenses borne by the franchisee.
The FDD states that failure to comply with these post-termination requirements will cause irreparable harm to Deer Solution, and the franchisee consents to a court order allowing Deer Solution to take action at the franchisee's expense. This highlights the importance of adhering to the franchisor's requirements to avoid legal repercussions and financial burdens after the franchise agreement ends. This is a fairly standard clause in franchise agreements across industries, as franchisors need to protect their brand identity.
