"Competitive Business" refers to and means any business that is the same as or similar to a Deer Solution Business including, but not limited to, any business that offers and/or provides services and/or products relating to deer repellent services, deer damage control and repair. What This Means (2025 FDD)
According to the 2025 Deer Solution Franchise Disclosure Document, franchisees are required to protect the confidentiality of the Business Management System Data. The FDD defines "Confidential Information" to include, among other things, Business Management System Data.
The Business Management System Data includes forms, data, tools, customer information, and inventory and sales information entered into or maintained on the Business Management System. This means a Deer Solution franchisee must treat all of this data as confidential and protect it from unauthorized disclosure.
Upon termination or expiration of the Franchise Agreement, the franchisee must cease using the Business Management System Data. This obligation ensures that the franchisee does not use confidential information to compete with Deer Solution after the franchise relationship ends. This is a standard practice in franchising to protect the franchisor's proprietary information and maintain a competitive advantage.
