Is a Deer Solution franchisee required to exclusively purchase and use System Supplies from Deer Solution or its designated suppliers?

At all times, Franchisee's Deer Solution Business shall: (a) be operated within Franchisee's Operating Territory, excluding Closed Markets; (b) be operated from an approved Administrative Office located within the Operating Territory; (c) exclusively offer, sell and provide the Approved Services and Products in accordance with Franchisor's standards, specifications, and requirements; (d) ensure that the Approved Services and Products are only offered and provided by Franchisee through employees and/or Owners that have, to Franchisor's satisfaction, completed the training requirements and Training Programs required by Franchisor; (e) exclusively use, maintain, and, stock in inventory, the System Supplies in such quantities as designated by Franchisor; (f) exclusively purchase the System Supplies from the supplier and/or suppliers, vendor and/or vendors approved by Franchisor and designated by Franchisor, in Franchisor's Reasonable Business Judgment

What This Means (2025 FDD)
According to the 2025 Deer Solution Franchise Disclosure Document, franchisees are required to exclusively purchase and use System Supplies from suppliers approved and designated by Deer Solution. System Supplies include equipment and supplies required for the Deer Solution business, including Deer Solution branded, non-branded, and third-party branded items. These supplies are designated for use in the day-to-day operations, encompassing equipment, deer repellent, materials, uniforms, stationary, sales slips, receipts, customer notices, and other forms and materials specified in the Operations Manual or in writing.
This requirement ensures uniformity and quality control across all Deer Solution franchise locations. By mandating the use of approved System Supplies, Deer Solution aims to maintain consistent service standards and protect its brand reputation. This also allows Deer Solution to potentially negotiate better pricing with suppliers, which could indirectly benefit franchisees.
However, this requirement also means that franchisees have limited flexibility in sourcing supplies and may be subject to the pricing and availability dictated by Deer Solution's approved suppliers. While Deer Solution states that supplier designations are made in its Reasonable Business Judgment, franchisees bear the risk of potential cost increases or supply chain disruptions from these designated sources. Franchisees are responsible for maintaining sufficient inventory of System Supplies as designated by Deer Solution.
